Adult Reviews Ninja respects the intellectual property rights of others and expects its users, contributors, and third parties to do the same.

This policy describes how copyright owners may submit notices of alleged copyright infringement concerning material available on adultreviewsninja.com (the “Site”) and how affected parties may submit counter-notifications.

Notice of Alleged Copyright Infringement

A copyright owner, or a person authorized to act on the copyright owner’s behalf, may submit a written notification requesting the removal or disabling of access to material that the owner believes infringes copyright.

To be effective under 17 U.S.C. § 512(c)(3), the notification should include substantially all of the following information:

A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.

A statement that the information contained in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of the exclusive right allegedly infringed.

Notices that do not contain the required information may be delayed, rejected, or returned for clarification.

How to Submit a Notice

Please clearly identify the submission as a DMCA Copyright Infringement Notice and include all information listed above.

We may provide a copy of the notice, including the complainant’s identity and contact information, to the person who posted or supplied the allegedly infringing material. We may also disclose the notice where required by law or as reasonably necessary to investigate and process the claim.

Misrepresentations

Under 17 U.S.C. § 512(f), a person who knowingly and materially misrepresents that material or activity is infringing may be liable for damages, including costs and attorneys’ fees.

Before submitting a notice, the complaining party should consider whether the disputed material may be authorized by the copyright owner or protected by an applicable legal doctrine, including fair use.

Removal or Disabling of Material

After receiving a valid notification, we may remove or disable access to the identified material and take other action that we consider appropriate.

Where applicable, we may notify the person who posted or supplied the affected material and provide information about submitting a counter-notification.

Counter-Notification

A person whose material has been removed or disabled as a result of a copyright infringement notice may submit a written counter-notification if that person believes the material was removed or disabled because of mistake or misidentification.

To be effective under 17 U.S.C. § 512(g)(3), the counter-notification should include substantially all of the following information:

The person’s physical or electronic signature.
Identification of the material that was removed or disabled and the location at which the material appeared before it was removed or disabled.
A statement, under penalty of perjury, that the person has a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
The person’s full name, mailing address, and telephone number.
A statement that the person consents to the jurisdiction of the appropriate United States federal district court for the judicial district in which the person’s address is located.
If the person’s address is outside the United States, a statement that the person consents to the jurisdiction of any United States federal district court in which the service provider may be found.
A statement that the person will accept service of process from the person who submitted the original infringement notice or that person’s agent.

Please clearly identify the submission as a DMCA Counter-Notification and include all information listed above.

After receiving a valid counter-notification, we may provide a copy to the person who submitted the original notice. Subject to applicable law, the removed material may be restored unless the original complainant notifies us that legal proceedings have been initiated to restrain the allegedly infringing activity.

The statutory process generally provides for restoration after 10 to 14 business days following receipt of a valid counter-notification, unless the service provider receives notice that the complainant has filed a qualifying court action.

Repeat Infringer Policy

Where appropriate and in accordance with applicable law, Adult Reviews Ninja may restrict or terminate access for users or contributors who are determined to be repeat copyright infringers.

We may also remove content, reject submissions, suspend access, or take other action where we reasonably believe repeated or serious infringement has occurred.
